The green circle is the “splashpad” the developer submitted in its application. The red circle is the splashpad the developer built. After this was discovered, the Town granted the developer a retroactive permit. The developer faced no fine or penalty. The developer has yet to obtain the proper DEP permit for the graywater, contaminated by human use, that will exit the splashpad into the harbor.
